By accessing or using Fruit Merge, you agree to these Terms of Play. If you do not agree with these terms, please do not use the game.
1. About Fruit Merge
Fruit Merge is a browser-based puzzle game available through Play2048.com.au. Players combine matching fruit, build higher-value fruit, earn achievements, record statistics, participate in leaderboards and, where available, create a public player profile.
Fruit Merge may be updated, expanded, modified or rebalanced over time. Game mechanics, scoring values, achievements, leaderboards, assists, fruit progression and other features may therefore change.
2. Eligibility and player accounts
You may play Fruit Merge without providing unnecessary personal information. Where account registration is available, you may be asked to provide a player name, email address and password.
You are responsible for keeping your login credentials secure and for activity carried out through your account. You should use a unique password and must not knowingly allow another person to use your account to manipulate scores, rankings or achievements.
Player names must be appropriate for a general audience. You must not use a name that impersonates another person or organisation, infringes intellectual property rights, contains unlawful or seriously abusive material, or is otherwise inappropriate for the service.
We may rename, restrict, suspend or remove an account where this is reasonably necessary to protect the game, other players, the service or third parties.
3. Passwords and account recovery
Registered players may use the password-reset system where available. Password-reset links are temporary, single-use links associated with the relevant account.
You are responsible for maintaining access to the email address associated with your account. We cannot guarantee account recovery where you no longer control that address or where an account does not contain sufficient information to verify ownership.
4. How gameplay is recorded
Fruit Merge performs ordinary gameplay in your browser so that moves can respond immediately without waiting for a server request after every action.
A game may use server-issued game information and deterministic game logic. At the end of a game, gameplay data may be submitted to the server so that the game can independently reconstruct or validate the result before saving scores, statistics, achievements or leaderboard records.
Local browser storage may also be used to preserve an active game, preferences or temporary progress. Clearing browser data, changing devices, using private browsing or disabling required browser features may affect locally stored information.
5. Fair play
Fruit Merge is intended to be played through the normal game interface. You must not deliberately manipulate the service in a way that gives you an unfair or artificial advantage.
In particular, you must not:
- submit fabricated or altered scores;
- tamper with requests or stored game data for the purpose of manipulating rankings;
- exploit bugs or vulnerabilities to obtain illegitimate progress;
- automate abusive or excessive traffic to the service;
- attempt to interfere with the operation or security of the website;
- access another player's account without permission;
- attempt to bypass account, rate-limit or security controls; or
- use the service for unlawful purposes.
We recognise that browser-based games cannot prevent every form of automation or client-side modification. Where a score, achievement or game record appears invalid, corrupted, technically impossible or inconsistent with verified game data, we may exclude it from public rankings or other competitive features.
6. Scores and leaderboards
Fruit Merge may display public leaderboards including lifetime total score, best non-assisted score, best assisted score and team performance.
Leaderboard calculations may change where required to improve fairness, correct errors or accommodate new game features. For example, team rankings may use an average or another normalised measure rather than simply adding the scores of every team member.
Leaderboard positions are not guaranteed to remain permanent. Rankings can change as other players improve their results, game rules are adjusted, invalid scores are removed or calculation methods are corrected.
Fruit Merge does not offer cash prizes or monetary value for leaderboard positions unless a separate promotion expressly states otherwise and provides its own terms.
7. Assisted and non-assisted games
Fruit Merge may provide optional gameplay assists such as Shuffle, Prune and Orchard Sweep.
Use of an assist may cause a game to be classified as an assisted game. Assisted and non-assisted results may be recorded or ranked separately.
Assists are game features only. They have no cash value, cannot be redeemed for money and do not represent property or currency owned by the player.
8. Achievements, statistics and progression
Fruit Merge may record gameplay statistics, achievements, milestones and progression associated with your player account. These may include scores, games played, moves, merges, active play time, fruit progression, assists used and other gameplay events.
Achievement requirements and statistical definitions may be adjusted where necessary to correct errors, rebalance progression or introduce new features.
Achievements, badges, statistics and similar game records have no monetary value.
9. Teams
Players may be able to select a fruit team. Team selection, eligibility and ranking rules are determined by the current version of the game.
Team standings may be calculated using average scores or another method designed to reduce the advantage of simply having a larger number of players.
We may change team-scoring methodology where reasonably necessary to improve fairness or accommodate changes to the game.
10. Restarting, resetting and deleting progress
Restarting an individual game starts a new board and does not normally erase lifetime account statistics or achievements.
Where Fruit Merge provides a full reset or delete-progress feature, using that feature may permanently remove game history, statistics, achievements, scores, preferences or other associated progress.
You should carefully review any confirmation message before performing a permanent reset. Information that has been permanently deleted may not be recoverable.
11. Advertising
Fruit Merge may display advertising supplied by third-party advertising providers, including Google.
Advertisements are separate from Fruit Merge gameplay. The appearance of an advertisement does not constitute an endorsement of the advertised product, service or organisation.
Third-party advertising providers may use cookies, device information or similar technologies in accordance with their own policies and applicable privacy requirements. Further information is provided in the site's Privacy and Cookie policies.
12. Social sharing and external services
Fruit Merge may provide buttons that allow you to share the game through social networks, messaging applications or your device's native sharing features.
When you choose to use a third-party service, your interaction with that service is governed by its own terms and privacy practices. Fruit Merge is not responsible for the availability or operation of third-party platforms.
13. Availability and interruptions
We aim to keep Fruit Merge available and functioning reliably, but uninterrupted access cannot be guaranteed.
The game may occasionally be unavailable or affected by hosting issues, maintenance, browser behaviour, network conditions, software updates, database maintenance, third-party services or circumstances outside our reasonable control.
Temporary failures may result in delayed score submission, unavailable leaderboards or other interrupted features. Where practical, the game may retain local data and attempt to continue or resume play.
14. Bugs, exploits and data corrections
Software can contain errors. If a bug causes incorrect scores, duplicated rewards, impossible achievements, corrupted statistics or other inaccurate records, we may correct, remove or recalculate the affected data.
If you discover a serious bug or security issue, please report it rather than deliberately exploiting it.
15. Intellectual property
Unless otherwise stated, the Fruit Merge game, software, design, graphics, illustrations, badges, interface, written content, branding and other original material associated with the service are protected by applicable intellectual property laws.
You may use Fruit Merge for personal, non-commercial gameplay. These terms do not grant permission to copy, redistribute, sell, reproduce or commercially exploit substantial parts of the game or its original assets without permission.
16. Privacy
Personal information and technical information associated with Fruit Merge are handled in accordance with the site's Privacy Policy and, where applicable, Cookie Policy.
Public player profiles and leaderboards may display information such as your chosen player name, fruit avatar or team, scores, achievements and gameplay statistics. Do not use a player name that reveals personal information you do not want displayed publicly.
17. Suspension or termination
We may restrict, suspend or terminate access to Fruit Merge where reasonably necessary because of abuse, cheating, security threats, unlawful activity, serious breaches of these terms or conduct that materially disrupts the service or other players.
Where appropriate, we may instead remove a score from a leaderboard or disable particular competitive features without deleting the player's entire account.
18. No guarantee of permanent data retention
We take reasonable steps to maintain game data, but Fruit Merge is not intended to operate as a permanent archival or data-storage service.
Scores, statistics, achievements or account data may occasionally be lost, corrected or become unavailable because of technical failures, maintenance, corruption, software changes or events outside our reasonable control.
19. Disclaimers
Fruit Merge is provided for entertainment purposes. To the extent permitted by law, the service is provided on an "as available" basis and we do not guarantee that it will always be uninterrupted, error-free or compatible with every browser, device or network.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including any rights that may apply under the Australian Consumer Law.
20. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential loss arising from your use of Fruit Merge, including loss of gameplay progress, rankings, statistics or access caused by technical interruptions or third-party services.
This limitation does not apply where liability cannot lawfully be excluded or limited.
21. Changes to Fruit Merge or these terms
We may update Fruit Merge and these Terms of Play from time to time. Changes may be made to reflect new features, changes in technology, legal requirements, security improvements or changes to gameplay.
The current version of these terms will be published on this page together with its updated date. Continued use of Fruit Merge after updated terms take effect constitutes acceptance of the revised terms.
22. Governing law
These Terms of Play are governed by the laws applicable in New South Wales, Australia, subject to any rights you may have under laws that apply regardless of this provision.
